What are my rights???????

Small claims court is that expensive. If your "friend" does not give you back your deposit, you need to file a small claims at your local Superior Court house. Your written agreement should be enough proof to show breach of contract and you will need proof he was paid the deposit, i.e. canceled check, large withdrawal from bank account.
